AK Steel Settlement In The News

In a settlement valued at $179.5 million, AK Steel company has agreed to extend medical benefits coverage for a class of retirees represented by the law firms Wallace & Graham and Coleman Edwards.  AK Steel will pay an additional amount to the plaintiffs' attorneys.  For more information, read this article in Pension & Benefits Daily, reprinted with permission from the Bureau of National Affairs.

The website for the Duke Energy Pension Lawsuit Settlement is online at  The website contains details of the settlement agreement concerning Duke Energy's Cash Balance Plan, including answers to frequently asked questions, a copy of the notice, key court documents, and tools for class members to update their addresses and view their estimated settlement amounts.

The parties have informed the Court that they have reached an agreement in principle to settle all claims in the litigation, and anticipate presenting a settlement to the Court for its consideration and approval in the near future.  The parties cannot otherwise comment on the settlement process or terms at this time.

Alcoa Medical Benefits Litigation

Wallace & Graham represents over 3000 retirees and their spouses who were employed by Alcoa and Reynolds Metals throughout the U.S. in their aluminum smelters and other plants. The clients include participants in the retiree health care plan sponsored and administered by Alcoa. The plaintiffs allege that Alcoa modified the plan in violation of their vested rights and in violation of its fiduciary duty by requiring the plaintiffs to make large financial contributions to their health care plan beginning January 1, 2007. The changes included monthly coverage premiums not previously required, and higher deductibles, co-pays, and co-insurance amounts for health care benefits. Plaintiffs alleged that such a change to their vested health care benefit Plan is a breach of contract and a breach of duty under various federal laws.

The lawsuit has been filed in the Federal Court for the Eastern District of Tennessee. A copy of the original Complaint that was filed in the case may be viewed here.
