Defective Products
Manufacturers, distributors and sellers of consumer products and goods are required to meet various safety standards and laws. Where a defective or dangerous product injures a consumer, there are certain legal rights which are available.
Wallace & Graham has assisted many clients who have sustained personal injury as a result of exposure to a dangerous product.
Examples of defective and dangerous products may include the following:
- Motor vehicles
- Airbags
- Door latches
- Steering mechanisms
- Consumer goods
- Home appliances
|
- Drugs and medical devices
- Washing machines
- Dishwashers
- Dryers
- Refrigerators
- Water filters
|
Sometimes, defective products may not cause any personal injury, but may still give rise to legal rights because the product does not work the way it was supposed to. This may be the case with consumer goods and appliances, as well as “lemon” vehicles that need costly repairs and service.
Here are some examples of product liability cases that Wallace & Graham has handled:
- We sued a major auto manufacturer for the death of a pregnant mother. She had gotten out of her minivan. Then, the van transmission moved into gear and ran over her, killing her. We alleged that the van needed an interlocking device to keep it from moving into gear. The interlocking device was practical at the time, and would have cost very little to include. We alleged that if the interlocking device had been in place, our client would not have been killed. We were able to obtain a settlement for the family of this deceased mother and wife.
- Our firm was recently involved in a case for a client hurt by a cutting tool used at a furniture manufacturer. The tool was a cutting head for a machine that carved decorative designs in doors. The lawsuit claimed that the tool broke into numerous pieces that flew across the factory floor. One piece hit our client in the chest. Because of the location in his chest, his doctors could not remove the piece of the tool. So, it remains in his chest even to this day. The lawsuit claimed that the cutting tool was defectively manufactured. We sued the manufacturer of the tool. We obtained a settlement for our client.
