Duke Energy & Aetna Disability Benefit Cases

Wallace & Graham has filed various lawsuits against Aetna Life Insurance Company in Greenville, South Carolina for a declaration of retirees’ rights under ERISA with respect to their entitlement to long-term disability under Duke Energy’s long-term disability plan. Each of the plaintiffs were disabled while working for Duke and were paid long term disability benefits for some period of time by Aetna as Duke’s insurer of its long-term disability plan. These plaintiffs also had a workers’ compensation claim against Duke and/or received Social Security disability payments. The issue involves whether Aetna is entitled to offset long-term disability compensation by other income or recoveries received and if so, to what degree.
